By accessing and purchasing from www.fernbankstudio.co.uk, or www.FernbankStudioUK.etsy.com you agree and are bound by these Terms & Conditions.


1. Digital Rights

1.1 All generated digital artwork (with the exception of final logo files) is original and intellectual property of Fernbank Studio and as such must not be copied or used without consent. 

1.2 All supplied artwork is intellectual property of the owner as stated. 

1.3 Any copyrighted artwork must not be recreated without prior consent from the original owner. 

1.4 The artwork proof provided by Fernbank Studio for custom stamps or stationery is for approval by the Buyer only and MUST NOT be used digitally i.e as a profile picture on social media. The Buyer can enquire about obtaining the rights to the digital file by email.

1.5 The Buyer may request up to three proof variations at the time of ordering. Two further proof revisions for corrections are permitted making up to five revisions in total. If the Buyer requests additional proof revisions, these will be charged at £2 per revision. The goods will not be dispatched until the fee has been settled.

1.6 The Buyer must understand that there are likely to be colour variations when viewing digital proofs for any printed stationery. Colours will vary from screen to screen and will also be different on final printed goods due to the various print systems used.

1.7 Once the Buyer has approved a proof, the manufacturing process may begin immediately so alterations after giving approval may not be possible.

1.8 Fernbank Studio operates an Angel Policy for use of any pre-made stamp design. The designs are suitable for personal, charity or small business use unless otherwise stated. Items created from the stamps must be made by hand and not mass produced. There is a limit of 100 copies of a product per year that can be produced. Stamped images cannot be used to create company logos or for other similar commercial brand use. Finished products may not be used in any way that implies an endorsement of your items by, or an affiliation with Fernbank Studio. It is not necessary to obtain permission before purchase if you agree to these terms. 

2. Health and Safety

2.1 Fernbank Studio stamps are not CE tested and are advised for use by adults only. Any non-handmade items are sold as seen and the original product packaging should be referred to for health and safety information.

2.2 The materials used in the stamp manufacture process are proven to be non-toxic but are still undergoing official tests for food safety so cannot be recommend for the use with food products.

2.3 It is recommended to thoroughly wash hands and work surfaces after using stamp and ink products to avoid any contact with food or drink products. 

3. Returns, Refunds and Exchanges

3.1 If for any reason the Buyer is unhappy with any stock items (i.e ready-made and non-customised) from Fernbank Studio, the Buyer has the right to cancel their order within 14 days of receiving the goods. Sale items are not eligible for returns or refunds unless not as described.

3.2 The Buyer must inform Fernbank Studio by email or post of their decision to cancel and goods must be returned within 30 days in their original condition at the Buyer's expense. 

3.3 Upon receipt of the goods, after inspection, a full refund will be issued within 7 days. Payment transfer may take up to 14 days depending on the payment provider and it out of the control of Fernbank Studio. The Buyer is responsible for any goods that have been damaged in transit when returned so must ensure that sufficient packaging is used. 

3.4 Only if the goods are deemed to be faulty or incorrectly supplied will Fernbank Studio will cover the return postage costs. 

3.5 A refund will only be issued to the same buyer and payment method that was originally used to purchase the goods. 

3.6 Cancellations or returns are NOT accepted on any custom or personalised items. This is an industry standard policy. 

3.7 It is the Buyer's responsibility to check that all details provided are correct. If the Buyer has approved an item containing an error the Buyer is required to pay the full price for any correction or replacement.

3.8 If any supplied artwork or design requires alteration, a proof will be provided via email. Approval by the Buyer will be required before manufacture. 

3.9 If for any reason there has been an error in the manufacturing process and the goods received do not match the approved proof then the Buyer can request a replacement. 

These terms are in accordance with the Consumer Contracts Regulations June 2014 (previously known as the Distance Selling Regulations).

4. Products and Offers

4.1 Fernbank Studio reserve the right to change, modify or remove products without prior notice. 

4.2 All offers and promotions are made subject to availability. Quotes for custom items are valid for 7 days only unless otherwise stated.

4.3 Fernbank Studio reserve the right to alter the prices of any products. Any order placed prior to changes will not be affected.

4.4 Full payment of any goods is required before dispatch. Payment for any custom work must also be upfront. If custom design work has been carried out but the physical item is no longer required The Buyer will receive a partial refund, an artwork fee of £5 for custom stamps will be retained. Stationery fees will vary according to item.

4.5 Due to differences in paper and/or ink as well as the very nature of a stamp, there will be variations in the outcome and it is rare to get a perfect print every time. This is not a fault of the item.

4.6 All goods are made by hand so may have a slight quirk or charm to them. Fernbank Studio use a number of suppliers for materials who also manufacture by hand. The acrylic stamping blocks are cut and polished by hand so occasionally may have some slight scratches or minor chips due to this process, these items are not classed as faulty.

5. Shipping

5.1 All UK orders are sent via Royal Mail. Wherever possible orders are packaged so they can fit through a letterbox making delivery convenient and contact free. Occasionally, a courier may be used for large orders but the buyer will be informed before dispatch. 

5.2 Royal Mail aims to deliver First Class post within 1-2 working days and Second Class 2-3 working days but sometimes it may take a little longer. Please allow 10 working days for items to arrive before making contact. Please notify Fernbank Studio within 30 days of any missing items so that a claim can be made, otherwise a replacement may not be possible.

5.3 Fernbank Studio ships to the UK only via the website. UK and US shipping available via the Etsy shop (www.FernbankStudioUK.etsy.com). International orders are sent via Royal Mail international tracked airmail.

5.4  International orders usually take around 7-10 working days. Occasionally international orders may get held up in customs and this may take up to 25 working days. Please allow the maximum amount of time for your goods to arrive before making contact and allow additional time over public holidays.

5.5 In the event that an item is not delivered, a replacement item will be issued which is exact to the item ordered originally. It may not be replaced for another item at the Buyer's request. A refund may be given if the item is no longer available and there is no suitable substitute. This does not affect your statutory rights. 

5.6 Any additional duty, import taxes or redelivery costs relating to your country are the responsibility of the Buyer. Digital customs information is relayed and CN22 labels are added to parcels where necessary. The genuine value and contents of the parcel will be visible on the label to comply with customs requirements.
